The Prosecutor's Office rejected the lawyers’ motions of Mihran Poghosyan and Gevorg Kostanyan, accused in various criminal cases, to terminate the criminal prosecution of their defendants. According to the Prosecutor's Office, the argument that reconnaissance does not allow crossing the Russian border is unfounded.
"Examination of the materials of the criminal cases revealed that both defendants have not been declared wanted by the Russian law enforcement agencies in their jurisdiction, which is evidenced by the fact that they still use this circumstance to move freely in Russia. Thus, the argument presented by the mediations that the declared search does not allow them to cross the Russian border is unfounded.
As for the change or elimination of the measure of restraint chosen against the accused, the court, in Kostanyan's case, found that there is a high risk of hiding from the body conducting the proceedings, and in Poghosyan's case, the court assessed also the possibility that by remaining at large, he could have an illegal influence on those participating in the criminal proceedings.
The mentioned risks have not been eliminated, and the issue of changing the measure of restraint imposed on the accused can be discussed in the manner prescribed by law only after the latter report to the RA law enforcement bodies.
