"The current Constitution does not state that if the constitutional amendments refer to the Constitutional Court, it is not subject to preliminary constitutional control", Hrayr Tovmasyan, the chairman of the Constitutional Court, told reporters today.
According to him, however, there is a principle of law that a person has the right not to obey null and void acts. "As a lawyer, one of the authors of the Constitution, I just feel ashamed of what happened in our National Assembly yesterday. In such situations in Armenia a person does not have the right to judicial protection in the domestic system”,Tovmasyan said.
Tovmasyan also stated that the Constitutional Court had not received such a document, according to which he should be deprived of his post and continue working as a judge, so he will continue to go to work.
Yesterday during a special session the parliament adopted the draft constitutional amendments, according to which the term of office of three members of the Constitutional Court will be terminated. Hrayr Tovmasyan will continue to serve as a member of the Constitutional Court, the four members of the Constitutional Court will continue to hold office.
