He stresses the referendum thesis of the document as a more fundamental and nationwide way to make decisions. The judge is sure that by adopting the new Constitution the historical justice will be restored and liveliness will be given to the Declaration of Freedom.
The provisions of the declaration, according to him, were violated during the past 20 years. According to Kim Balayan the new project ofConstitution returns the power of the people to the people to adopt important resolutions through a referendum.
Kim Balayan also considers artificial the two stage system of parliamentary elections. According to him there is no need for a second stage and the thesis is unnecessary.
